1. Introduction
These Terms of Service (“Terms”) govern your access to and use of the website, quotation system, and related services operated by Made in Tianchang (“we”, “us”, or “our”).
By accessing or using our services, you agree to be bound by these Terms.
2. Scope of Services
We provide services including but not limited to:
- Product information and technical specifications
- Quotations and pricing references
- Order processing and order status tracking
- Communication and document exchange related to international trade
All information provided is for business reference purposes only and does not constitute a legally binding contract unless otherwise confirmed in writing.
3. Account Registration
- You must provide accurate and complete company and contact information.
- You are responsible for maintaining the confidentiality of your account credentials.
- All activities conducted through your account are deemed to be authorized by you.
4. Quotations & Orders
- Prices, lead times, and availability are subject to confirmation.
- A quotation does not constitute a final offer unless explicitly stated.
- Orders become binding only after written confirmation (e.g. Proforma Invoice, Sales Contract).
5. Payments
- Payment terms will be specified in the confirmed order documents.
- Common methods include bank transfer (T/T) unless otherwise agreed.
- All bank charges, currency conversion fees, and intermediary bank fees shall be borne by the buyer unless agreed otherwise.
6. Delivery & Risk Transfer
- Delivery terms shall follow Incoterms® 2020 unless otherwise specified.
- Risk transfers to the buyer according to the agreed Incoterm.
- Delivery dates are estimates and may be affected by production, logistics, or force majeure events.
7. Product Specifications & Quality
- Product specifications are based on confirmed documents.
- Minor variations within industry tolerances shall not be considered defects.
- Claims regarding quality or quantity must be raised within a reasonable period after receipt of goods.
8. Intellectual Property
All content, including product descriptions, images, documents, and trademarks, are the property of Made in Tianchang unless otherwise stated.
Unauthorized use, copying, or distribution is prohibited.
9. Limitation of Liability
To the maximum extent permitted by law:
- We shall not be liable for indirect, incidental, or consequential damages.
- Our total liability shall not exceed the amount paid for the relevant order.
- We are not responsible for losses caused by customs clearance issues, regulatory changes, or third-party logistics providers.
10. Force Majeure
We shall not be held liable for failure or delay in performance due to events beyond our reasonable control, including but not limited to:
- Natural disasters
- War, strikes, pandemics
- Government restrictions or port congestion
11. Termination
We reserve the right to suspend or terminate access to our services if:
- These Terms are violated
- Fraudulent or unlawful activities are suspected
12. Governing Law & Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of China.
Any disputes shall be submitted to the jurisdiction of the courts of China, unless otherwise agreed in writing.
